Legal Framework
These terms outline the use of our website and any purchases made through it. By using our site and placing orders, you agree to these terms.

Definitions

·       Contract – The agreement for sale and purchase of goods.

·       Delivery Area – The UK, including Northern Ireland (excludes BFPO addresses).

·       Goods – Products offered for sale on our website.

·       Service – Online tools, services, and information provided via our website.

·       Carrier – Third-party delivery service.

·       Content – All text, images, media, and data on the website.

·       Website – TheGreenEast.co.uk and related subdomains.

·       We/Us/Our – The Green East Ltd, registered in Northern Ireland (Company No. NI696381), with a registered office at Banana Block, Portview Trade Center, 310 Newtownards Rd., Belfast, BT4 1HE

Orders
When you place an order, it is an offer to buy goods from us and means you accept these terms. We may refuse any order at our discretion.

Your order is only confirmed—and a binding contract created—when we send you an order confirmation email.

If we cannot accept your order, any payment made will be refunded within 14 days.

It is your responsibility to ensure all order details are accurate and complete.

Goods, Pricing and Availability
We aim to provide accurate images and descriptions, but these are for guidance only. Plant photos may show typical features at certain growth stages, and actual goods may differ based on size and maturity.

Hanging plants may be shown in decorative pots, but shipped in standard pots without attachments. Sizes are approximate, and natural variations in size, shape, and colour are to be expected.

If a selected size is unavailable, we may substitute a larger or taller plant at no extra cost

Quoted plant heights include the stem, foliage, and pot depth. Handmade containers may vary in colour, shape, and size, adding to their unique character; minor imperfections are normal and not defects. Unless noted, pots are not guaranteed waterproof using a liner is recommended.

 

Prices shown include VAT

(VAT No. 442576975) and are correct at the time of publishing. We may change prices or offers at any time. If prices rise before dispatch, we will contact you to confirm if you wish to continue; if not, you can cancel without penalty.

If a pricing error occurs, we will inform you before dispatch and may cancel your order with a full refund.

Stock levels may vary due to seasonal and supplier changes. If we cannot supply an item, we may cancel the order. Product pages will show stock status or estimated availability. If your order includes items out of stock, we will usually ship everything together once all items are available.

Payment
Payment is taken when you place your order. If payment fails or details are incorrect, we may cancel the order and withhold delivery. Ownership of goods remains with The Green East Ltd until payment is received in full.

Card details are securely encrypted during transmission. By ordering, you consent to us sharing payment details with our payment provider. We do not store these details, but our provider may. We take reasonable steps to protect your data but are not liable for losses due to unauthorised access unless caused by our negligence.

Delivery
We deliver only within our designated delivery area. We aim to dispatch goods within the timeframe shown on product pages, or within 30 days of order confirmation unless otherwise stated.

As plants are perishable, delivery may be postponed if conditions are unsuitable. We will deliver to the address you provide—please ensure it is accurate, as we cannot refund delivery costs or accept responsibility for issues due to incorrect addresses.

Delivery times are estimates and not guaranteed. If delays occur due to events beyond our control, we will inform you. For significant delays, you may cancel the order and receive a full refund for any undelivered goods.

Risk and Ownership
Ownership of goods remains with us until full payment is received or delivery is completed, whichever is later.

Risk of damage or loss passes to you once the goods are delivered or the first delivery attempt is made, even if no signature is obtained. If you request a delayed delivery or to have items left unattended, this is at your own risk, and we are not liable for any damage, especially to plants.

For delivery requests or leaving items in secure locations, this is also at your own risk. We are not responsible for any loss or damage caused by adverse weather conditions.

Cancellations, Returns and Refunds
To cancel or change your order, email us with "Cancel Order" in the subject or use our "Contact Us" page.

Plants and Perishable Goods

·       Before Dispatch: Orders (excluding Special Orders & Made to Order Displays) can be cancelled before dispatch. A cancellation fee of up to 50% may apply.

·       After Dispatch:

o   Notify us within 7 days if plants arrive damaged or incorrect. Keep the original packaging for returns.

o   Contact us first for approval and provide photos if requested.

o   Damaged or wrong plants will be replaced or refunded at no charge.

o   Returns due to change of mind are at your expense within 7 days. We refund the plant cost if returned in original condition, but not delivery fees.

o   Plants must not be repotted; we cannot accept returns if they have been repotted.

o   After 7 days, we consider the plants accepted, and no further claims can be made due to their perishable nature and care outside our control.

o    

·       Special Order Plants & Plant Displays (Live & Artificial)
Orders for Special Order plants (including large specimens and HydroCare plants) and Made to Order plant displays (live or artificial) are non-cancellable and non-returnable due to their perishable or custom-made nature. These items are specifically sourced or assembled for you and are excluded from statutory cancellation rights.
Such items are clearly marked as "Special Order" or "Made to Order" on our website.

 

Faulty Goods
Notify us of any defects within 7 days of delivery or upon discovery if not obvious.

·       If the fault is confirmed(and not due to misuse, neglect, or normal wear), we will offer a replacement, refund, or repairat no cost. If a return is needed, we will arrange collection—please do not use alternative couriers, as we cannot reimburse those costs.

·       Please note: Variations in handmade ceramics (e.g., colour, glaze, shape) are natural and not considered faults. We may request phoos to assess any issues.

Incorrect Goods

·       If you receive the wrong items, notify us within 7 days of receipt. We will arrange collection via our courier—please do not use alternative services, as we cannot cover those costs.

·       You can choose to either:
(a) receive the correct items after we collect the incorrect ones, or
(b) receive a full refund, including delivery charges.

 

Change of Mind

In accordance with your statutory rights under the Consumer Contracts Regulations 2013, you may cancel your order for non-perishable goods within 14 days of delivery. You will then have an additional 14 days from the date of cancellation notification to return the goods to us, making a total return window of 28 days.

Please note that products identified as "Special Order" or "Made to Order" are excluded from this right and are non-cancellable and non-returnable, as detailed on the relevant product pages.

When returning your entire order due to a change of mind, your original shipping charges will also be refunded, up to the value of the least expensive delivery option offered at the time of order.

Returned items must be in original condition, with no signs of unreasonable use, and in their original packaging, along with your order reference number. We reserve the right to make deductions for any diminished value resulting from handling beyond what is necessary to assess the product.

Return shipping costs and the risk of damage or loss in transit remain your responsibility. We strongly recommend using a tracked and insured service, bearing in mind that many carriers do not cover live plants or fragile items against damage.

For planters and pots:
Please ensure adequate protective packaging is used. Individual product boxes are often insufficient, especially for large or delicate pots. Use double-walled outer boxes and wrap items thoroughly in heavy-duty bubble wrap or rigid cushioning paper, ensuring there is no movement during transit. Refunds cannot be issued for items returned damaged due to inadequate packaging.

Our Right to Cancel

We reserve the right to cancel your order and terminate the agreement under the following circumstances:

• The goods ordered are out of stock.
• Your delivery address is outside our designated delivery area.
• We have not received full payment for the order.
• The goods were listed at an incorrect price due to an administrative or technical error.
• In the event of defamatory, abusive, or inappropriate communication directed at our customer service team or publicly online.

Should we cancel your order, you will be notified by email, and any payments received will be refunded promptly, no later than 30 days from the date of your order.
We shall not be liable for any additional compensation or losses arising from such a cancellation.

Offers and Promotions

Only one promotional code may be redeemed per order. Promotional codes, discounts, or offers cannot be applied retrospectively to orders that have already been placed.

Promotional vouchers or codes are not valid for the purchase of gift vouchers or gift cards, nor can they be used to offset shipping charges. Additionally, shipping costs do not contribute towards any minimum spend requirements stipulated by promotional offers.

The Green East Ltd reserves the right to amend, suspend, or withdraw any promotional offers and their associated terms at its sole discretion and without prior notice. This includes changes to the "Horty Rewards" program, encompassing the allocation and redemption of "Horty Points." We also reserve the right to remove members from the rewards program where misuse or abuse is identified, without the need for prior notice.

Your statutory rights are not affected.

The Green East Ltd is committed to protecting your privacy and the security of your personal information.

Our Privacy Policy outlines how we collect, use, and protect the data you provide to us, as well as detailing the use of cookies and similar technologies on our website.

By accessing and using our website, you acknowledge and consent to the processing of your data in accordance with our Privacy Policy. You also confirm that all information you provide to us is accurate, complete, and current.

We strongly encourage you to review our Privacy Policy to fully understand our data handling practices and your associated rights.

Limitation of Liability

While The Green East Ltd makes every reasonable effort to ensure the accuracy of the information presented on our website, we make no representations, warranties, or guarantees, whether express or implied, regarding its accuracy, completeness, reliability, or suitability for any purpose.

Our website and all content therein are provided on an "as is" and "as available" basis, without any endorsements or representations. To the fullest extent permitted by law, we expressly disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, completeness, and any warranties arising by statute, common law, or otherwise from a course of dealing, usage, or trade practice.

We do not warrant that the website will operate uninterrupted, timely, securely, or free of errors, nor do we guarantee that any defects will be corrected, or that the website or its servers are free of viruses, malware, or other harmful components. You acknowledge that the use of our website is at your own risk.

We are not liable for any loss of content or data uploaded or transmitted via our website. The content of our website is for general information only and should not be relied upon as advice for making decisions or taking specific actions.

To the maximum extent permitted by applicable law, we exclude all liability for any losses or damages arising out of or in connection with your use of our website or any transactions made through it, whether such losses are direct, indirect, incidental, consequential, or special, including (without limitation) loss of profits, contracts, business, anticipated savings, data, goodwill, or reputation, whether arising in contract, tort (including negligence), misrepresentation (excluding fraudulent misrepresentation), or otherwise.

Nothing in these terms shall exclude or limit our liability for:

• Death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors.
• Fraud or fraudulent misrepresentation.
• Any matter for which it would be unlawful for us to exclude or restrict our liability.

Your statutory consumer rights remain unaffected.

Events Beyond Our Control

We shall not be liable for any failure or delay in delivering goods or fulfilling our obligations due to events beyond our reasonable control, including but not limited to strikes, natural disasters, accidents, pandemics, or government actions.

In such cases, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume as soon as possible.

Intellectual Property

All content on this website, including text, images, videos, and software, is owned by The Green East Ltd or relevant third parties. You may not reproduce, distribute, or use any material from this site without explicit permission.

Changes to Service and Terms

We reserve the right to modify the website and these Terms at any time. Any changes will apply upon your next use of the site. Changes required by law will automatically apply to pending and future orders.

No Waiver

Failure to exercise any rights in these Terms does not waive those rights.
